The TurboCare Division of Demag Delaval Turbomachinery Corp. ("TurboCare") is the owner of U.S. Patent No. 4,436,311 ("the 311 patent"), which is directed to a shaft sealing system for fluid turbines. TurboCare brought suit against General Electric Co. ("GE") in the United States District Court for the District of Massachusetts, asserting infringement of the 311 patent. The district court granted summary judgment of noninfringement as to claims 1, 5, 6, and 7 and invalidity as to claim 2. TurboCare appealed. We affirm the district courts judgment of invalidity as to claim 2, and we affirm-in-part and vacate-in-part the district courts judgment of noninfringement as to claims 1, 5, 6, and 7. We remand for further consideration of the infringement issues and consideration of the validity of claims 1, 5, 6, and 7 in light of our claim construction.
